Terms of Service
§ 1 Scope, contracting party
These terms govern the use of MyPostcards, the purchase of credit balance ("Credits"), and ordering printed, mailed postcards through this platform. The contracting party is [Name / company, address] (see Legal Notice). How we process your data along the way is covered in the Privacy Policy.
§ 2 Description of services
MyPostcards turns a single travel photo into a field-research-style postcard: location and date are read from the photo and confirmed by you, a decorative stamp is generated for the scene, and the finished card is deterministically composed from photo, stamp, and paper — the original photo is never redrawn. Several photos can also be uploaded together as a named "Field Trip Folder" and processed one after another. Any card can optionally get a back side with a message and a recipient address; finished cards can be managed, favorited, and searched in your gallery, or shared via a public link with no account needed. A card with a back side can additionally be ordered as a real, printed copy mailed to an actual postal address (§ 7). Every new account receives one free credit; every further postcard costs one credit from your purchased balance.
§ 3 Formation of contract
Creating an account is free. A paid contract for the purchase of credits is formed once payment is confirmed via our payment provider Stripe; only then is the balance credited to your account. A print order starts as a non-binding price quote; a contract is only formed once you enter a shipping address, expressly confirm the right-of-withdrawal notice (§ 5), and payment via Stripe completes successfully. Only then do we hand the print and shipping order to our fulfillment partner.
§ 4 Prices and payment
Current credit package prices are listed on the /pricing page, quoted in euros or US dollars depending on language. A print order's price is calculated individually for each order from our print partner's current print, shipping, and tax cost plus a margin, and shown to you as a fixed total before payment. Both are paid exclusively via Stripe (card). Credits are prepaid, do not expire, and are automatically refunded if a postcard generation fails. A paid print order is only submitted to our fulfillment partner once payment is received, and is binding from that point (§ 5).
[Add VAT details depending on business structure — small-business exemption under § 19 UStG, or regular VAT.]
§ 5 Right of withdrawal
Different legal bases for the right of withdrawal apply to purchasing credits (digital content) and to print orders (physical goods made to your own specification). A credit counts as "digital content not supplied on a physical medium" — the right of withdrawal under § 356 (5) BGB only lapses if you expressly agree, before completing the purchase, that performance begins immediately, and confirm that you thereby lose your right of withdrawal. This explicit consent is collected as its own required field in credit checkout, before payment can proceed.
[Also add a legally reviewed model withdrawal notice for digital content — the text above describes the actual flow, but doesn't replace a reviewed model notice.]
Print orders fall under the statutory exemption for made-to-order goods (§ 312g (2) no. 1 BGB) — see /widerrufsrecht for details. The explicit confirmation described there is already a required field in checkout, before payment can proceed.
§ 6 User content, rights, and obligations
You're responsible for owning the rights to, or being authorized to use, every photo you upload, and for making sure it doesn't infringe anyone else's rights or show unlawful content. You grant us the right to send your photo to the services named in the Privacy Policy for the purpose of image analysis, generating the stamp, and composing your postcard. If you enter another person's name, address, or a message for them — for a print order or a public link, for example — you're responsible for making sure that information is accurate and that the person has agreed to this use of their data.
§ 7 Shipping and delivery (print orders)
Print order shipping is currently limited to Germany, the rest of the EU member states, and the United Kingdom. Production happens at our print and fulfillment partner Prodigi, currently in Venlo, Netherlands. Because production and shipping are handled by an external partner, we can't guarantee a binding delivery time; you can see the processing status, and tracking once available, in your account.
§ 8 Referral program
Your personal referral link lets you invite other people to MyPostcards. Once the invited person confirms their email address, or completes sign-in via Google, you both receive one additional credit, one time. We reserve the right to reverse referral credits obtained abusively, for example through multiple accounts belonging to the same person.
§ 9 Availability and liability
MyPostcards depends on external services, including OpenAI, Stripe, Prodigi, and Supabase; we can't rule out temporary availability limitations caused by those services.
[Add a liability limitation after legal review — particularly for minor negligence regarding non-essential contractual obligations.]
§ 10 Account termination
You can delete your account yourself at any time from your account area; doing so irrevocably removes your stored postcards, credit history, and print order history with us (see Privacy Policy). We reserve the right to suspend or terminate accounts that violate these terms.
§ 11 Dispute resolution
The European Commission provides an online dispute resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr/.
[Add whether, and with which consumer arbitration board, we participate (§ 36 VSBG).]
§ 12 Final provisions
[Add governing law, jurisdiction, and severability clause after legal review.]
